Hi, people!

Long time no see! ^^
I hope everybody's well, happy and warm!

I'm currently living in Toronto (where it's bloody cold) and I was wondering if some of you were from there.

Also any of you work in artists studios I could maybe join? It'd be funnier than working from home.

I seem to have currently misplaced my Mojo. The darn little runt must have run off to somewhere. I'm guessing Bora Bora.
Without it, everything's taxing.
I wish I could take one, two, more days off to try and find it, but alas, life is not so easy that one freelance woman can take a day off whenever she wants to.
I tried to lure it back with chocolate, but alas, my stomach protested long before the Mojo was back.
I tried to lure it with all sorts of delicious tea, but again, my stomach protested it didn't want to swim in that much tea.
I tried to lure it with The Sarah Connors Chronicles on TV while I work, but alas, Brian Austen-Green's too cute to be compatible with work. It does not go well if I actually watch TV instead of working. So it broke my heart, but Brian had to go.
And my Mojo's still not back.
I figured I would take a few hours and work on my fairy tale, due next Halloween, to cheer me up. But my brains just wobbled and pouted like a blob of pudding. It just won't do the work without the Mojo.
So, Mojo, I know I ask a lot of you, but that's how much I need and love you. So please, come back home.
And tomorrow's plan:  tax return to fill. Oh joy. My Mojo's never going to come back.
Ah, the life.

I considered participating until I read the terms and conditions, specifically the licensing of submission/grant of rights.
I'm not sure Neil Gaiman read them, because it's in complete contradiction with what he says on his blog. Even if he made a book out of it, his publisher wouldn't have to pay the artist(s), they'd have to pay Blackberry.
Basically every art you submit becomes the property of Blackberry. They take all the rights, including commercials of each and every entry, without the obligation to even credit the authors.
Not to mention that part of Blackberry's grant of rights clause is illegal. They also claim the "moral rights" (droit moral, in French, because it's a specific thing of intellectual property here), which is illegal. Moral right can't be claimed, bought, or stolen.

Please read the terms before you submit anything and think about the consequences. I will not participate in the butchering of intellectual property, which is the only thing, and a tenuous thing at that, that protects (professional) artists. Wether they intend to use these rights or not, isn't the question, the principle's at stake here.

And I do resent the "art is easy" line. Art is not easy. It's freaking hard. It's decenies of hard work. I spent the last hour trying to understand how neck muscles work to draw them and I'll need a dozen more to get it. Art is FREAKING HARD.

I'm not trying to open a debate, I don't want to get sucked into one, so please don't flood my inbox, if we disagree, there's nothing we can do to convince each other. Just, please, read the terms and mull them over. That's all I ask:

Participants also agree that RIM may have access to, may have created, or may in the future create designs, ideas and concepts that may have familiarities or similarities to his/her Submission, and that he/she will not be entitled to any compensation or right to negotiate with the RIM because of these familiarities or similarities.


EDIT:
If you like Gaiman, you can still do a fanart and post it in your gallery instead of the contest. This way Blackberry can't steal the rights. That's way cooler.

EDIT2: Apparently Gaiman contacted Blackberry regarding the problems and they're drafting a new legal contract.

BUT, and that's the BUt that will have me not even do a fanart about it, not only has Gaiman NOT read the terms, because he's quoting Blackberry, but his own last jab is implying we're overracting over nothing:  

"And as they [BlackBerry] explained to me, 'Regarding us taking ownership of people's work (i.e. – them losing the copyrights), in fact this is not what the T&Cs say! I think we've suffered from an unfortunate case of misconstrued legalspeak. We're licensing people's artwork for use, but they retain all rights to their own work. To do with it what they will!' I'm hopeful that the new set of T&Cs will be clearer, and have asked them to put something up to clarify all this for the worried, the troubled, the confused, or the nervous."

Again, read the terms: Just because it is a non-exclusive contract doesn't change the fact they grant themselves rights they shouldn't have and without giving anything, even credit in return. And no, it's not in our heads, for God's sakes, they even tried to claim the moral rights, which is ILLEGAL. I'm glad Gaiman asked them to modify the terms, really, but his last line, well, he disappointed me.

Anyway, rant over, this just leaves me very disappointed and bitter. We're reverting back to the days before copyright was invented to protect artists from companies that would use their work without credit or pay. I'm goint back to work, now. Just had to take it off my chest =_=

KITTENS!!!

1- Belated Happy New Year!! I know 2013 is going to be awesomely awesome because it's the year of the Snake, which is my Chinese sign (new respect for the scally varmint!)
Thank you for your support and kindness!!

2- I just got my visa/permit to go live in Canada for 12 months. It's just great! ^^
I'm now in the process of panicking because that means finding a tenant for my flat, renting a flat in Toronto, getting insurance, getting ready. PANICK is going to be wild!

I'm just so happy!
